Warranty and Product Conformity Policy

This Warranty and Product Conformity Policy explains the rights and procedures that apply where a Product purchased through https://cheatprovider.store is defective, damaged, incomplete or otherwise does not conform to the purchase contract.

This Policy applies to:

  • DMA hardware;
  • display fusers;
  • electronic devices and accessories;
  • other Physical Products;
  • Software Licenses;
  • Digital Products;
  • Products containing digital elements;
  • replacement Products and components; and
  • Product bundles.

This Policy forms part of the Terms of Service and should be read together with the Refund and Cancellation Policy, Shipping and Returns Policy and applicable End User License Agreement.

Nothing in this Policy excludes or restricts mandatory rights that cannot lawfully be excluded.


1. Merchant of Record and Product-Support Roles

1.1 Contracting Seller

Purchases completed through the applicable checkout are sold and transactionally administered by:

OVGC Payment Services FZ-LLC

OVGC acts as the full Merchant of Record and contracting seller for the transaction.

1.2 OVGC Responsibilities

OVGC is responsible for transaction-related matters including:

  • checkout and payment administration;
  • billing and invoicing;
  • administration of applicable transaction taxes;
  • financial refunds and price reductions;
  • chargebacks; and
  • transaction-related compliance.

1.3 BellTower Responsibilities

BellTower operates CheatProvider and handles Product-related matters including:

  • technical support;
  • Product diagnostics;
  • License administration;
  • assessment of reported defects;
  • Software corrections and updates;
  • repair and replacement coordination;
  • communication with Manufacturing Partners;
  • return instructions; and
  • recommendations to OVGC concerning financial remedies.

1.4 How Claims Are Handled

BellTower will normally investigate the Product issue and coordinate the appropriate technical or fulfilment remedy.

Where the legally appropriate remedy is a refund or price reduction, the financial transaction is normally executed by OVGC.


2. Statutory Rights and Commercial Warranties

2.1 Statutory Legal Guarantee

Consumers may have mandatory statutory rights where a Product does not conform to the purchase contract.

These rights arise by law and do not depend on BellTower or OVGC issuing a separate warranty certificate.

2.2 Commercial Warranty

A commercial warranty is an additional voluntary promise that may provide rights beyond the statutory legal guarantee.

A commercial warranty exists only where it is expressly stated:

  • on the Product page;
  • in the order confirmation;
  • in a warranty certificate;
  • in Product documentation; or
  • in another written statement forming part of the purchase.

2.3 No Reduction of Statutory Rights

Any commercial warranty is provided in addition to mandatory statutory rights.

A commercial warranty does not replace, restrict or shorten the legal guarantee of conformity.

2.4 Use of the Word “Warranty”

References to “warranty” in ordinary support communications do not create an additional commercial guarantee unless the scope, duration and guarantor are clearly stated.


3. When a Physical Product Conforms

A Physical Product generally conforms to the contract where it:

  • matches the agreed description, type, quantity and quality;
  • has the functionality and compatibility agreed at purchase;
  • is suitable for any particular purpose accepted as part of the contract;
  • is supplied with agreed accessories and instructions;
  • is suitable for the purposes for which Products of that type are ordinarily used;
  • has the qualities a Consumer may reasonably expect;
  • corresponds with relevant samples, models or public Product statements;
  • is correctly assembled where assembly was part of the contract;
  • can be installed in accordance with the supplied instructions; and
  • complies with applicable mandatory Product requirements.

The exact contractual requirements depend on the Product description, order confirmation, Product specifications and information presented before purchase.


4. Physical Product Defects

A Physical Product may be defective or non-conforming where, for example:

  • it does not power on under supported conditions;
  • an essential component is missing;
  • the wrong Product or model was supplied;
  • it materially differs from the agreed specifications;
  • it was damaged before risk passed to the Customer;
  • it contains a manufacturing defect;
  • an advertised function does not operate;
  • it cannot be installed because supplied instructions are materially incorrect;
  • it is incompatible with a configuration expressly stated to be supported; or
  • it otherwise fails to meet mandatory conformity standards.

A cosmetic variation that does not materially affect agreed appearance, functionality, safety or value is not necessarily a defect.


5. Goods with Digital Elements

5.1 Meaning

A Product with digital elements is a Physical Product that contains or depends on Software or another digital component in such a way that the Product cannot perform its functions without it.

This may include hardware requiring:

  • firmware;
  • drivers;
  • configuration software;
  • activation services;
  • License validation;
  • Product updates; or
  • another connected digital component.

5.2 Conformity of Digital Elements

Where digital elements form part of the purchase contract, conformity may require:

  • delivery of the agreed digital component;
  • functional compatibility with supported systems;
  • required security updates;
  • agreed functionality;
  • correct installation instructions;
  • continued provision for the agreed period; and
  • other updates reasonably required to maintain conformity.

5.3 Third-Party Components

Where the Product depends on third-party hardware, operating systems, drivers, firmware or platforms, the Product is assessed against the compatibility and requirements represented at the time of purchase.

BellTower does not guarantee compatibility with every future third-party change unless such continued compatibility was expressly agreed or is required by mandatory law.


6. Digital Product Conformity

A Digital Product or Software License generally conforms where it:

  • matches the agreed description and version;
  • provides the agreed functionality;
  • is delivered or made accessible as agreed;
  • works with supported hardware and software;
  • includes agreed instructions and support materials;
  • receives required updates;
  • maintains agreed continuity where continuously supplied;
  • does not contain a material defect preventing ordinary supported use; and
  • otherwise satisfies applicable mandatory conformity requirements.

Conformity is assessed according to the purchase contract, Product page, supported environment, License terms and reasonable expectations created by BellTower or OVGC.


7. Matters That Are Not Normally Defects

A Product is not normally defective merely because:

  • the Customer changed their mind;
  • the Customer expected a feature that was not advertised;
  • the Product does not support hardware or software that was not listed as supported;
  • the Customer’s system does not meet published requirements;
  • the Customer installed the Product incorrectly;
  • a third-party service, platform or account is unavailable;
  • a third party restricted or banned the Customer;
  • the Customer failed to install a required update;
  • an unsupported modification was made;
  • normal wear and tear occurred;
  • the Product was damaged after delivery;
  • the License expired according to its agreed duration;
  • a temporary maintenance period occurs;
  • a Lifetime License reaches the end of the supported commercial life of the Product under the applicable terms; or
  • the Customer no longer has a personal use for the Product.

This Section does not override mandatory legal rights where the actual circumstances amount to non-conformity.


8. Customer-Side Causes and Exclusions

Except where mandatory law provides otherwise, BellTower and OVGC are not responsible for defects or damage caused by:

  • accident, impact, crushing or liquid exposure;
  • fire, excessive heat, moisture or unsuitable storage;
  • electrostatic discharge;
  • incorrect voltage, power supply or cabling;
  • improper installation;
  • failure to follow Product instructions;
  • use outside published specifications;
  • unsupported hardware, firmware, drivers or operating systems;
  • overclocking or electrical modification;
  • soldering or unauthorised component replacement;
  • opening or modifying sealed components where this caused the defect;
  • malware or compromised Customer systems;
  • Customer-installed third-party software;
  • unauthorised repair attempts;
  • removal or alteration of serial numbers;
  • License sharing or circumvention;
  • loss, theft or misuse after delivery;
  • normal wear and consumable deterioration; or
  • another act or omission attributable to the Customer or a third party.

The fact that a Product has been opened or examined does not by itself remove statutory rights. An exclusion applies only to the extent that the relevant act caused or materially contributed to the claimed problem.


9. Compatibility Requirements

9.1 Customer Review Before Purchase

Customers should review the Product page and Documentation for:

  • supported operating systems;
  • motherboard and hardware requirements;
  • required connections or interfaces;
  • supported firmware and driver versions;
  • required third-party software;
  • regional limitations;
  • installation requirements;
  • required technical knowledge; and
  • known exclusions.

9.2 Express Compatibility Statements

Where BellTower expressly represents that a Product supports a particular configuration, that representation forms part of the conformity assessment unless clearly corrected before purchase.

9.3 Unlisted Environments

Absence of an environment from the supported list does not mean that compatibility is guaranteed.

Customers should contact support before purchase where their intended configuration is unclear.

9.4 Changes After Purchase

A Product does not automatically become defective because the Customer later:

  • changes hardware;
  • reinstalls or replaces the operating system;
  • updates unsupported firmware;
  • changes a third-party platform;
  • installs conflicting software; or
  • moves outside the supported configuration.

10. Software and Firmware Updates

10.1 Required Updates

BellTower may provide updates necessary to:

  • maintain contractual functionality;
  • correct defects;
  • maintain compatibility;
  • address security risks;
  • comply with legal requirements; or
  • maintain the conformity of a Product with digital elements.

10.2 Customer Installation Duties

The Customer must install required updates within a reasonable period after being informed of:

  • the availability of the update;
  • the purpose of the update;
  • the consequences of failing to install it; and
  • any relevant installation instructions.

10.3 Failure to Install an Update

BellTower and OVGC may not be responsible for a lack of conformity resulting solely from the Customer’s failure to install a properly supplied update where:

  • the Customer was appropriately informed;
  • the update and instructions were made available;
  • the failure was not caused by deficient instructions; and
  • the exclusion is permitted by applicable law.

10.4 Updates Do Not Guarantee Unlimited Support

An update obligation does not necessarily require indefinite support for:

  • obsolete operating systems;
  • unsupported hardware;
  • discontinued third-party platforms;
  • unmaintained drivers;
  • unavailable external services; or
  • Products beyond their agreed support period.

Mandatory update obligations remain unaffected.


11. Duration of Statutory Protection

11.1 Consumer Goods

Consumers in the European Union generally receive a minimum two-year statutory legal guarantee for new goods, beginning when the Product is delivered.

Longer periods may apply under the mandatory law of the Consumer’s habitual residence.

11.2 Digital Products

The legally applicable period for Digital Products depends on whether the Product is:

  • supplied once;
  • supplied through repeated individual deliveries; or
  • supplied continuously for an agreed period.

Where digital content or a digital service is supplied continuously, responsibility for conformity may continue throughout the agreed supply period.

11.3 Goods with Continuously Supplied Digital Elements

Where a Physical Product includes digital elements supplied continuously for an agreed period, the statutory responsibility for those digital elements may continue throughout that period or for another minimum period required by law.

11.4 Limitation Periods

The deadline for bringing or enforcing a legal claim may differ from the period during which conformity must exist.

Mandatory limitation and suspension rules remain unaffected.


12. Burden of Proof

12.1 Consumer Presumption

Where a lack of conformity in a Physical Product becomes apparent within the period prescribed by applicable consumer law, it may be presumed that the defect already existed when risk passed to the Consumer.

Under German law, this presumption generally applies for one year after delivery, unless it is incompatible with the nature of the Product or defect.

12.2 Digital Products

Special burden-of-proof rules may apply to Digital Products and continuously supplied digital elements.

The applicable rule depends on the Product type, delivery structure and period during which the issue becomes apparent.

12.3 Customer Cooperation

A Consumer may still be required to provide reasonable information showing:

  • which Product is affected;
  • what issue occurs;
  • when it occurs;
  • the supported environment used; and
  • why the Product cannot be used as expected.

A request for reasonable diagnostic information does not reverse a statutory burden of proof.


13. Remedies for Non-Conforming Physical Products

13.1 Restoration of Conformity

Where a Physical Product does not conform, an eligible Customer may first be entitled to have conformity restored through:

  • repair;
  • replacement;
  • replacement of an affected component;
  • correct delivery of missing components;
  • Software or firmware correction; or
  • another appropriate remedy.

13.2 Choice Between Repair and Replacement

Where applicable law gives a Consumer a choice between repair and replacement, the requested option may be refused if it is:

  • impossible;
  • disproportionately expensive compared with the alternative; or
  • otherwise excludable under mandatory law.

The alternative remedy must remain available where legally required.

13.3 Free of Charge

Statutory restoration of conformity must be provided free of charge where required by law.

This may include necessary:

  • parts;
  • labour;
  • shipping;
  • removal;
  • installation; and
  • other required costs.

13.4 Reasonable Time and Inconvenience

A statutory remedy will be completed within a reasonable period and without significant inconvenience to the Consumer, taking account of:

  • the Product type;
  • the nature of the defect;
  • the purpose for which the Product is required;
  • parts availability;
  • international shipping requirements; and
  • other relevant circumstances.

14. Remedies for Non-Conforming Digital Products

14.1 Bringing the Product into Conformity

The initial remedy for a Digital Product may include:

  • providing missing access;
  • reissuing or reactivating a License;
  • correcting Account association;
  • providing replacement files;
  • repairing a Software defect;
  • providing an update;
  • correcting compatibility within the supported environment;
  • restoring an agreed service; or
  • providing another appropriate technical solution.

14.2 Time and Cost

Where mandatory law applies, conformity must be restored:

  • free of charge;
  • within a reasonable period; and
  • without significant inconvenience to the Consumer.

14.3 Access Required for Diagnostics

BellTower may ask the Customer to perform reasonable troubleshooting or supply diagnostic information necessary to identify and correct the issue.

Remote access is not mandatory unless it is reasonably necessary, proportionate and accepted by the Customer.


15. Price Reduction or Contract Termination

A Consumer may be entitled to a proportionate price reduction or termination of the contract where the legal requirements are met, including where:

  • repair or replacement is impossible;
  • the seller refuses to restore conformity;
  • the remedy is not completed within a reasonable period;
  • the defect remains after an appropriate remedy attempt;
  • the defect is sufficiently serious;
  • repair or replacement would cause significant inconvenience;
  • it is clear that conformity will not be restored; or
  • mandatory law otherwise permits the remedy.

Termination may not be available for a minor lack of conformity where applicable law excludes it.

Where a refund or price reduction is approved, OVGC normally executes the financial transaction.


16. Repair Procedure

16.1 Authorisation

A Product must not be sent for repair until BellTower has supplied authorised instructions.

16.2 Repair Location

Depending on the Product, repairs may be performed by:

  • BellTower;
  • a Manufacturing Partner;
  • a designated repair centre;
  • a component supplier;
  • a qualified third-party technician; or
  • another authorised service provider.

16.3 Repair Methods

A repair may involve:

  • component replacement;
  • board-level repair;
  • firmware installation;
  • Software correction;
  • configuration reset;
  • replacement of an equivalent part;
  • cleaning where required for function; or
  • another appropriate technical action.

16.4 Repaired Product

A repaired Product may retain its original serial number or receive a replacement serial number depending on the repair performed.

Mandatory rights concerning the repaired Product remain unaffected.


17. Replacement Procedure

17.1 Replacement Product

Where replacement is the appropriate remedy, the replacement may be:

  • the same model;
  • a technically equivalent successor model;
  • a refurbished replacement where legally permitted and appropriate;
  • a replacement component; or
  • another Product accepted by the Customer.

17.2 Material Differences

A materially different substitute will not be imposed on a Consumer where consent is legally required.

17.3 Return of Original Product

The original Product may need to be returned before a replacement is dispatched.

In appropriate cases, BellTower may arrange an advance replacement subject to:

  • identity and order verification;
  • return of the original Product;
  • security against non-return where legally permitted;
  • stock availability; and
  • additional written conditions.

17.4 Ownership

Where a Product is permanently replaced, ownership of the returned defective Product may pass to the contracting seller or designated service provider where permitted by law.


18. Shipping and Return Costs for Warranty Claims

18.1 Valid Statutory Claims

Where a Product is covered by a valid statutory conformity claim, necessary shipping, return, repair and replacement costs are borne as required by applicable law.

18.2 Authorised Return Method

The Customer must follow the supplied return instructions, including:

  • the correct return address;
  • the authorised carrier or shipping method;
  • customs instructions;
  • the return reference;
  • packaging requirements; and
  • any required documentation.

18.3 Unauthorised Costs

BellTower or OVGC may decline to reimburse unreasonable or avoidable costs resulting from:

  • use of an unauthorised premium carrier;
  • shipping to the wrong address;
  • failure to use a supplied prepaid label;
  • incorrect customs declarations;
  • cash-on-delivery shipment;
  • inadequate packaging; or
  • another failure to follow reasonable return instructions.

This does not affect necessary costs that must be reimbursed under mandatory law.

18.4 No Defect Found

Where inspection establishes that:

  • the Product conforms to the contract;
  • the issue results from an unsupported configuration;
  • the defect was caused by the Customer;
  • the Product was materially modified; or
  • the reported issue cannot be reproduced,

BellTower may provide the inspection result and return the Product.

A Business Customer may be charged reasonable inspection and shipping costs where permitted by contract and law. A Consumer will not be charged merely for making a good-faith statutory claim unless a lawful basis exists and the costs were properly disclosed.


19. Packaging Products for Return

A Product returned for inspection, repair or replacement should be:

  • securely packaged;
  • protected against impact and electrostatic discharge;
  • sent with required accessories;
  • free from unrelated attachments;
  • identified with the authorised return reference;
  • accompanied by the requested defect description; and
  • prepared according to the supplied instructions.

The original packaging should be used where reasonably available and suitable.

The Customer may be responsible for additional damage caused by inadequate return packaging.


20. Customer Data and Configuration

20.1 Backups

Before returning a Product or permitting repair, the Customer must make reasonable backups of any important data or configuration.

20.2 Removal of Personal Information

The Customer should remove:

  • personal files;
  • passwords;
  • account credentials;
  • network credentials;
  • encryption keys;
  • third-party License information; and
  • other confidential information.

20.3 Reset and Data Loss

Inspection, repair or replacement may require:

  • factory reset;
  • firmware replacement;
  • Software reinstallation;
  • storage replacement;
  • configuration deletion; or
  • replacement of the entire Product.

Unless expressly agreed otherwise, data recovery or preservation is not part of the warranty service.

20.4 License Reassociation

Where repair or replacement changes the Product’s hardware identifier, BellTower may reassociate an eligible License with the repaired or replacement Product.


21. Serial Numbers and Product Identification

BellTower may use the following to identify a Product and verify eligibility:

  • order number;
  • serial number;
  • Product identifier;
  • License identifier;
  • Manufacturing Partner reference;
  • shipping record;
  • photographs;
  • hardware identifier; and
  • other relevant fulfilment records.

Removing, altering or obscuring a serial number may prevent identification of the Product.

A claim will not be rejected solely because original packaging or a paper receipt is unavailable where purchase and Product eligibility can be established through other reliable evidence.


22. Product Safety Issues

22.1 Stop Using Unsafe Products

If a Product:

  • overheats abnormally;
  • emits smoke or a burning smell;
  • shows battery swelling;
  • creates sparks;
  • has exposed electrical conductors;
  • causes electrical shocks; or
  • otherwise appears unsafe,

the Customer should stop using it immediately, disconnect it where safe to do so and contact BellTower.

22.2 Safety Information

BellTower may request photographs, serial information, usage details and storage instructions necessary to assess the issue.

22.3 Recall or Corrective Action

Where a Product presents a confirmed safety or compliance risk, BellTower, OVGC, the manufacturer or a competent authority may provide:

  • a warning;
  • updated instructions;
  • a Software or firmware update;
  • a repair programme;
  • a replacement programme;
  • a recall; or
  • another corrective measure.

Customers must follow reasonable safety and recall instructions.


23. Third-Party Products and Components

Some Products may contain or be supplied with third-party components.

A third-party manufacturer may offer its own commercial warranty.

Where such a warranty applies:

  • the third party’s warranty conditions may govern claims under that voluntary warranty;
  • the Customer may be referred to an authorised service centre; and
  • BellTower may assist with proof of purchase or Product identification.

A third-party commercial warranty does not remove the Customer’s mandatory rights against the contracting seller.


24. Replacement Parts and Consumables

Replacement parts and consumable components may have different expected service lives from the main Product.

Normal depletion or wear of a consumable is not a defect where:

  • the part performed for a reasonable expected period;
  • the wear is consistent with normal use;
  • no contrary durability promise was made; and
  • mandatory law does not provide otherwise.

A replacement component remains covered by applicable statutory rights.


25. Lifetime Licenses and Product Discontinuation

25.1 Meaning of Lifetime

A Lifetime Software License remains valid for the supported commercial lifetime of the relevant Product, as defined in the Terms of Service and Product terms.

It does not mean:

  • the lifetime of the Customer;
  • the lifetime of the Customer’s computer;
  • unlimited support for every future third-party environment;
  • a promise that external platforms will remain unchanged; or
  • an indefinite commercial warranty.

25.2 Discontinuation

Product discontinuation does not automatically establish non-conformity where:

  • the Product reached the end of its properly defined commercial life;
  • the limitation was disclosed or follows from the agreed Product terms;
  • mandatory support and update obligations were satisfied; and
  • the Product otherwise conformed during the required period.

Mandatory rights concerning promised duration, updates and continued digital supply remain unaffected.


26. Reporting a Warranty or Conformity Issue

26.1 Contact BellTower

26.2 Information to Include

Please provide:

  • Account email address;
  • order number;
  • Product and model;
  • serial number or License identifier;
  • date the issue began;
  • description of the issue;
  • steps already attempted;
  • system specifications where relevant;
  • photographs, video, logs or error messages; and
  • the requested resolution.

26.3 Proof of Purchase

BellTower or OVGC may request reasonable proof of purchase.

Acceptable evidence may include:

  • order confirmation;
  • invoice or receipt;
  • OVGC transaction reference;
  • Account order history;
  • reseller invoice;
  • serial-number records; or
  • other reliable transaction evidence.

26.4 Independent Reseller Purchases

A Customer who purchased from an independent reseller must generally contact that reseller as the contracting seller.

BellTower may nevertheless provide technical assistance or manufacturer-level support where appropriate.


27. Diagnostic Process

BellTower may ask the Customer to complete reasonable diagnostic steps, including:

  • checking connections;
  • installing supported drivers or firmware;
  • using a supported operating system;
  • reinstalling Product software;
  • testing another supported port or cable;
  • providing logs or screenshots;
  • confirming Product and system versions;
  • temporarily disabling conflicting software;
  • participating in a remote-support session; or
  • returning the Product for inspection.

Diagnostics must be proportionate to the issue and must not cause unreasonable inconvenience to a Consumer.

A Customer should not perform electrical, soldering or disassembly work unless expressly instructed and technically qualified to do so.


28. Remote Inspection and Support

Where appropriate, BellTower may offer remote support to determine whether the issue arises from:

  • Product configuration;
  • Software installation;
  • License activation;
  • driver conflict;
  • unsupported hardware;
  • Customer-side network conditions;
  • third-party software; or
  • a Product defect.

The Customer should close unrelated applications and remove confidential information from view before granting remote access.

Remote support does not replace physical inspection where physical inspection is reasonably necessary.


29. Abuse and Fraudulent Claims

BellTower may investigate suspected warranty abuse, including:

  • substitution of another Product;
  • altered serial numbers;
  • false defect reports;
  • fabricated photographs or documents;
  • deliberate damage;
  • return of missing or counterfeit components;
  • repeated claims involving different accounts;
  • retention of a replacement and original Product;
  • malicious payment disputes; or
  • other fraudulent conduct.

Confirmed abuse may result in:

  • rejection of the fraudulent claim;
  • Account restriction;
  • License suspension;
  • recovery of replacement or inspection costs;
  • disclosure to OVGC, carriers or authorities; and
  • legal action where appropriate.

Good-faith warranty claims will not be treated as abuse merely because the defect is difficult to reproduce or the claim is ultimately unsuccessful.


30. Business Customers and Resellers

30.1 Consumer Protections

Consumer-specific legal guarantee rules do not apply to purchases made mainly for trade, business, resale or professional purposes unless mandatory law provides otherwise.

30.2 Commercial Claims

Claims by Business Customers are governed by:

  • the applicable commercial contract;
  • the Reseller Agreement;
  • the Product-specific terms;
  • any express commercial warranty;
  • applicable commercial law; and
  • this Policy.

30.3 Inspection and Notification

Business Customers must inspect Products promptly and report visible damage, quantity discrepancies and apparent defects within any period required by the applicable contract or commercial law.

30.4 Resold Products

An independent reseller is responsible for statutory remedies owed to its own end customers where the reseller is the contracting seller.

BellTower may provide repair, replacement or technical support to the reseller according to the Reseller Agreement.


31. Refunds and Price Reductions

Where a refund, price reduction or contract termination is legally or voluntarily approved:

  • BellTower may disable the associated License;
  • Digital Product access may be withdrawn;
  • the Physical Product may need to be returned;
  • replacement entitlement may end;
  • the Customer must stop using refunded Software; and
  • OVGC normally processes the financial adjustment.

Further payment and refund rules are contained in the Refund and Cancellation Policy.


32. Liability and Other Legal Claims

This Policy describes Product-conformity and warranty remedies.

It does not exclude any separate mandatory claim relating to:

  • personal injury;
  • Product safety;
  • property damage;
  • fraud;
  • gross negligence;
  • intentional misconduct;
  • product liability;
  • data-protection rights; or
  • another claim that cannot lawfully be excluded.

Any limitation of liability is governed by the Terms of Service and applicable mandatory law.


33. Mandatory Consumer Rights

Nothing in this Policy excludes, restricts or replaces mandatory rights under:

  • German consumer law;
  • EU consumer law;
  • the mandatory law of the Consumer’s habitual residence; or
  • another applicable consumer-protection regime.

In particular, this Policy does not exclude mandatory rights concerning:

  • conformity of goods;
  • conformity of Digital Products;
  • goods with digital elements;
  • required updates;
  • repair;
  • replacement;
  • price reduction;
  • contract termination;
  • refunds;
  • damages where legally available; or
  • burden-of-proof protections.

Where this Policy conflicts with mandatory law, mandatory law prevails.


34. Changes to This Policy

This Policy may be updated to reflect:

  • new Products or Product types;
  • changes to repair or replacement procedures;
  • changes to Manufacturing Partners;
  • changes to Software and update obligations;
  • changes to the Merchant-of-Record arrangement;
  • changes in applicable law; or
  • clarifications and improvements.

The version applicable to a purchase will normally be the version incorporated into the contract at the time of purchase, subject to later mandatory legal requirements.
