Withdrawal Instructions

These Withdrawal Instructions explain the statutory right of withdrawal that may apply to purchases made by Consumers through the CheatProvider Platform.

These instructions should be read together with:

  • the Terms of Service;
  • the Refund & Cancellation Policy;
  • the Shipping & Returns Policy;
  • the Warranty & Product Conformity Policy;
  • the applicable Product description; and
  • the End User License Agreement (EULA).

Where mandatory consumer protection law grants stronger rights than described in these instructions, those mandatory rights prevail.


1. Scope

These Withdrawal Instructions apply only where:

  • the purchaser is a Consumer;
  • mandatory law grants a statutory right of withdrawal; and
  • the purchase was concluded through the CheatProvider Platform or another sales channel where these instructions were provided.

These instructions do not apply where no statutory withdrawal right exists under applicable law.

Business Customers purchasing for commercial or professional purposes generally do not benefit from statutory consumer withdrawal rights.


2. Merchant of Record

Purchases made through the CheatProvider checkout may be processed by:

OVGC Payment Services FZ-LLC

OVGC acts as the Merchant of Record for the relevant transaction and is responsible for payment processing, invoicing and transaction administration.

Where OVGC is the Merchant of Record, withdrawal requests concerning the purchase transaction may be processed by OVGC on behalf of the transaction.

Product support continues to be provided by BellTower where applicable.


3. Right of Withdrawal

If you are a Consumer, you may have the legal right to withdraw from your purchase within fourteen (14) days without giving any reason, unless a statutory exception applies.

The withdrawal period is generally:

  • 14 days from conclusion of the contract for digital services;
  • 14 days from delivery of goods for physical Products;
  • or another period required by applicable law.

The precise commencement of the withdrawal period depends on the nature of the purchased Product and the applicable legal provisions.


4. How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must notify the Merchant of Record or the designated withdrawal contact before expiry of the applicable withdrawal period.

Your declaration should clearly state your decision to withdraw.

You may use:

  • the Model Withdrawal Form;
  • an email;
  • a written declaration;
  • a customer support ticket;
  • another durable medium accepted by the Merchant of Record; or
  • another legally recognised method.

Use of the Model Withdrawal Form is optional.


5. Withdrawal Contact

Where the transaction was processed by OVGC Payment Services FZ-LLC, withdrawal requests should normally be submitted using the support or contact information supplied:

  • during checkout;
  • within the order confirmation;
  • on the invoice or receipt; or
  • through the customer support channel specified for the transaction.

6. Effects of Withdrawal

If you validly withdraw from a contract:

  • the contract is reversed in accordance with applicable law;
  • payments received for the withdrawn contract are refunded where legally required;
  • delivery obligations cease unless otherwise required by law;
  • digital access may be disabled;
  • License Keys may be revoked where legally permissible;
  • subscriptions may terminate; and
  • other legal consequences apply as required by applicable consumer law.

Refunds are normally issued using the same payment method used for the original transaction unless another method is expressly agreed.


7. Digital Products

Many CheatProvider Products consist of digital content or digital services supplied electronically.

Examples include:

  • software;
  • software licenses;
  • license keys;
  • subscriptions;
  • digital downloads;
  • online activation;
  • customer account entitlements; and
  • other digital products.

For such Products, statutory withdrawal rights may expire before the end of the normal withdrawal period if:

  • performance begins immediately at your request;
  • you expressly consent to immediate performance before expiry of the withdrawal period; and
  • you acknowledge that you thereby lose your statutory right of withdrawal where applicable law provides for this consequence.

Where required by law, these confirmations are obtained during the checkout process before digital delivery begins.


8. Software Licenses

Where Software or License Keys are supplied electronically and immediate access is requested by the Consumer, withdrawal rights may cease once the statutory conditions for loss of the withdrawal right have been satisfied.

If those statutory conditions have not been fulfilled, the Consumer retains any withdrawal rights provided by applicable law.


9. Subscription Services

For subscription-based Products:

  • the initial purchase may be subject to statutory withdrawal rights;
  • renewals are governed by the applicable contract terms;
  • termination rights remain governed by the Terms of Service and Refund & Cancellation Policy; and
  • mandatory statutory rights remain unaffected.

10. Physical Hardware

For physical Products:

  • withdrawal normally requires return of the goods where applicable;
  • the goods should be returned without undue delay after withdrawal;
  • the Product should be packaged appropriately to avoid transport damage;
  • reasonable inspection by the Consumer remains permitted under applicable law; and
  • mandatory consumer rights remain unaffected.

11. Return Shipping

Where return of goods is required:

  • the applicable return address will be provided during the withdrawal process;
  • the party bearing return shipping costs depends upon the applicable contract terms and mandatory law;
  • Products should not be returned before receiving return instructions where such instructions are reasonably necessary; and
  • customs documentation may be required for international shipments.

12. Diminished Value

Where permitted by applicable law, Consumers may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of returned goods.

Normal inspection comparable to that possible in a retail environment does not by itself create liability.


13. Exceptions to the Right of Withdrawal

Applicable law provides various exceptions under which a statutory right of withdrawal may not exist or may expire early.

Examples may include:

  • digital content supplied immediately after the legally required consents;
  • digital services already fully performed where the statutory conditions are satisfied;
  • custom-made or personalised Products where applicable law provides such an exception;
  • sealed goods that are not suitable for return for health or hygiene reasons once unsealed, where applicable;
  • Products inseparably mixed with other items after delivery where applicable; or
  • other statutory exceptions provided by mandatory law.

Whether an exception applies depends on the specific Product and the applicable legal provisions.


14. Refund Timing

Where a withdrawal results in a refund:

  • refunds are processed within the time required by applicable law;
  • verification of returned goods may be required where permitted;
  • digital access may be revoked before completion of the refund process where legally permissible;
  • refunds are normally issued through the original payment method unless another method is agreed; and
  • no fee is charged for the refund itself unless permitted by law.

15. Partial Withdrawal

Where an order contains multiple Products, withdrawal may apply only to the affected Product where legally permissible.

The remaining parts of the contract continue unaffected unless applicable law requires otherwise.


16. Consumer Rights Remain Unaffected

These Withdrawal Instructions concern only statutory withdrawal rights.

They do not limit:

  • statutory warranty rights;
  • product conformity rights;
  • rights arising from defective performance;
  • contractual guarantees;
  • mandatory consumer protection rights; or
  • other legal remedies available under applicable law.
